Nintendo suing Palworld

So what are some likely ramifications on the future of the gaming industry for one side or the other winning the lawsuit?
Palworld wins, nothing changes other than nintendo has more competition in pokemon-likes, nintendo wins, it could destroy tons of games from being made, at least in japan.
 
I think Palworld will survive without the balls because the core game is still kept intact. Still bad on paper because it's on the same level as Namco with games during loading screens or the word Edge getting copyrighted.

I still believe that Palworld could've had "tubes" like I saw in the Dragon Quest Dai manga.

I have badly slept for a few days so I didn't notice what I was saying lol.

But I'm wondering, how Yokai-Watch catching and summoning system worked? I know that SMT had your PDA (or laptop) to select which demo you want to bring (which is strangely similar to how pokémons are stored in computers in the games) but I'm seriously wondering if it's mostly Nintendo/TPC/Creatures going into paranoia mode because of soccer moms thinking that this games with guns is Pokémon.

I could understand them stopping bootlegs you often see ads of on mobile or Youtube since they're obviously stealing designs and misleading people but this isn't one obviously.

I mean you still saw plenty of gory Flash games with Nintendo IPs and they never tried to shut down these sites for hosting them.

Yo-Kai Watch was completely different — you befriend the monsters by giving them things in battle or winning in-game events, and then they give you a medal that can be used to summon them later with the titular watch. The series actually outright references Pokemon at several points, but always through lawyer-friendly parodies, and all the monster designs and gameplay mechanics are original and distinct from Game Freak’s IP.

i do want to apologise for the "DEI" discussion, but someone was being really ignorant about it. it isn't really relevant, anyway.

in terms of the lawsuit, i hope pocketpair will win. nintendo is an evil company.
 
both Nintendo and Sony suck as companies, best case scenario is a pyrrhic vistory for Sony.
Microsoft are better in some regard but in the meantime they're also making bad decisions and the Xbox brand barely exists as a console hardware to the point I'm not even sure the next gen will have one.

Sony winning would also be awful considering how they killed most of their Japanese IPs, selling a console for a price beyond sanity (without a disc drive on top of that) while having little to no exclusives for it.

I think none of the 3 are going to win this war, pc has been gaining and recently surpassed the consoles in total gamers and consoles in general while getting more owners, they seem to not be getting nearly the same amount of game sales as they did in the past, as much as i hate to give this to microsoft, they likely see the writing on the wall, gamers are going towards mobile for casual, and pc for more traditional gaming.

To be blunt part of their insanity is probably related to the fact that consoles are slowly trying to become walled garden pc's and failing, so the 3 companies are flailing to survive and be profitable in a space that is slowly starting to no longer need them.
 
they're all bad. there are no AAA companies i think are good. they only care for profit.
thats why i said pyrrhic victory, i want sony to technically win the lawsuit, therefore not establishing a legal precedent to trademark really simple and broad game mechanics, but for it to cost them so much that they don't get to enjoy the fruits of victory

 
This lawsuit reminded of the time Capcom sued Data East over Fighters History’s infringement of Street Fighter II.
 
I've read other places that internally, Nintendo are quite proud of their litigousness. Their bully tactics shied me away from buying anything after the wii.

On the dei talk: I never understood why people engage so much with the clickbaity alarmist stuff on youtube. Im not a fan of dei, but I simply avoid it and give no mindspace to the media that contains it; being angry and upset 24/7 is a chore. Having a franchise you love being changed to fit in hamfisted social narratives can be a bit disheartening, but you have to know when to let the zombie walk on and stop provoking it to eat your brains. Whats dead is dead, but you can cherish the memory while persuing a new love.

But some dialogue in "woke" media reminds me of the beat-you-over-the-head-with-a-bible evangelical movies I watched as a kid. Theres very little subtlety, and the dialogue comes off very pushy and inflexible. Adding onto that, there are sometimes thinly veiled revenge fantasies and social commentary mixed in, which leave a bad taste in the mouth. Often the media isn't inviting you in or subtely showing you a different way or side of life, its "you're wrong and evil for not believing what we believe"; its oppositional and decisive.

Art has to be artful; you can't just paint middle fingers all the time, because you won't be taken seriously by anyone outside your middle finger enjoying ingroup.

My take from working at a few large companies is this: Once you have an army of lawyers at your disposal, you have to find ways to keep them busy. Stuff like that is an inevitable consequence of success.

I don't really care about the DEI stuff, because I believe that every company has the right to operate as they see fit. I don't see it is anyone's business to dictate to other companies how they operate. If their products offend you that much, don't watch or support them.

Having said all that, what they've done to Star Wars and Lord of the Rings is appalling. They made those franchises unwatchable. And there are others too, like the Witcher and Wheel of Time that deviated strongly from their source material for various reasons, including misguided views on what being a progressive is all about.

This frankly reminds me of Sony vs Bleem! -- even if the courts agree that Palworld is right (like they did with Bleem!), Nintendo's much deeper pockets can harass them into bankruptcy or steamroll them for a laugh.
