Nintendo suing Palworld

the more i see these kinds of things happen the more my anger boils over and i want to punch things. yet even if i do nothing will stop corrupt greedy bastards like these from copyrighting basic game mechanics and systems. this right here is the reason we have never seen the nemesis system outside of the shadow of war/mordor games and it makes me physically ill to think no one can do anything to stop it.
 
What happened to this case? Has anyone been keeping up with it? I heard that Palword is collaborating with Terraria, now – how can that be happening?

I would say Nintendo and Pal made up and kissed and became Pals, but sadly it’s four months too early to make this joke.
 
I'm surprised TemTem is fine because it's more like a turn based JRPG with monster collection than that Ark-like game.
 
i'm the same way. they're bullies, i won't fund them.

Microsoft, pushes DEI and ugly characters, if you don't you can't sell on their store

Sony America - Censorship happy and DEI happy. If Sony Japan didn't push DRM, their PSN account requirements, and digital-only i'd consider them worth supporting, except when they are on top they make stupid mistakes which then makes me skip them a generation or three.

Nintendo - Bullies overall, but especially to fans and romhackers and people wanting to just play games on anything but 'official' devices.


Then every other day there's information of so many game devs who have just gone insane with the DEI and ugly girl-boss characters, and 'the message' is more important than the game (like other games, the storefront and getting you to pay to win is more important than the game or even having fun). Thankfully everyone is checking out en-mass.

I think there are small legalese text that says about playing a game outside of the intended hardware (on the NES I think there was a small text about it). Not to say they're right but for Switch games proving you own the game legitimately is hard.

But I agree about fangames and romhacks (although thankfully some of the sites like romhacking dot org are left by them).

If i own it, it doesn't matter how i decide to use it/enjoy it. I don't care what their legalese says. Sides it's unenforceable. Unless i signed a legal document in blood i'm not subject to their TOS or EULA.

Oh it's just that I read that one has to dump yourself your own files instead of finding them online.

Of course they won't verify all the time but I feel that when emulators get shut down it's mostly because they show they can run games that didn't come out yet.

Being able to (or in theory can) run something shouldn't matter, it's the something itself that should be the only thing in contention.

Though those writing emulators can (and should use) any games they get access to in order to improve the emulators; BUT not advertise states of compatibility or progress until the game is available.

It's like having weed. I may have and/or smoke it, but i don't wave it around in front of everyone and the police, i keep it to myself.

Regardless, Nintendo lost their good will when they sued and took down a HTML5 fan project of Mario 1-1 that was just a test example of what you can do with HTML5 back like 8 years ago. They haven't proved themselves any better since.

that's not correct. if you purchase something that has a clause stating that "by purchasing this software, you agree to..." then you *are* bound by it.

Nope. you got it totally wrong. DEI is the result of pushing unqualified people into the roles they shouldn't be in.

So example: Say you have town's firefighter group, and it's set up where there's 30 men and 2 women (or everyone that qualified on the physical tests). DEI states you have to have 50% women. So you have to throw out 13 qualified men to get 13 women who can't do the job the men can just to fit those quotas. Then tote 'we made the 50/50! We are diverse!' Then a fire breaks out and the women can't carry people out of a building that's on fire and people die and some of them die too.

If women can do the job then great. But if they can't Meritocracy is the way to go.

What if i bought it second hand and it was already activated/installed? And it's really none of their business. If i decide to crack open a beer using a hammer and it has a clause 'not to open beers with hammer' i really don't care.

If i own something i do what i want with it.

That's the reason why rom hosting sites like Emuparadise or Vimm's Lair got shut down, people couldn't stop talking about it (same with fangames, at least AM2R got out while being completed).

I don't do drugs either but it's safer to not claim to have TBs of roms, musics and movies not legitimately owned.

Technically they are in the right since it could be considered a bootleg/counterfeiting even if it's a free demo. I do agree that a fan game made by passionate fans isn't like Somari or the awful world of bootlegs but it's the same way that Nintendo is more prone to stop anything using their IPs (yet clones like The Great Giana Sisters are somehow still a thing despite that it was an obvious rip off).

I think Nintendo are fine with most games like Zelda inspired indie games or even platformers as a whole but not when using their assets or character designs. This is why I'm always encouraging devs to have a fully original game so they could profit from it while avoiding any C&D.

And let's not forget that even Sega decided to shut down SoR Remake because you had the original three games included (thus potentially making them lose sales).

Some are even hiring people to carefully read laws to find ways to circumvent them.

In the instruction booklet of a product they also say what not to do (mostly to avoid getting sued by daredevil people misusing them).

Not sure what the copyright laws are in Japan, but two things invented/made by different people are both considered legitimate. The US copyright pushes that there should be a 25% difference between products. Pretty sure HTML5 and NES are completely different in encoding structure and architecture. A case could be made that the encoding for the level is so wildly different as to be more than 25% different (level 1-1 in the NES rom is like 114 bytes).

The sprites not so sure how those would pan out, and the HTML5 i'm not sure if it had music or sound effects or not. But like a video of someone playing it, it would probably fall under fair use (unless they can nix every video with mario in it ever), especially since it wasn't being sold.
 
I'm late to the discussion but I think these patents that Nintendo filled out in Japan are absolute bullshit and shouldn't hold up in any sane court of law. I was joking in another forum that they should fight some of these lawsuits by showing that their spheres are actually polygons.

The problem is this is the japanese legal system, not us legal system, so nintendo stands a good shot of winning here, even though they didn't develop the method they claim (ironically a GTA mod did).

Yeah, that is a fair point, I have no idea how the Japanese patent legal system works. All I know is that in the US it is almost impossible to patent an idea. Generally patents are for inventions and they involve schematics or source code to back them up. You can patent a particular method of solving a problem but you can't patent all solutions to a problem.
 
I laughed when I saw Palworld (update?) in this year's GOTY awards. Devs know they have something on their hands and are going ahead with their project. I wish more companies stood alongside Palworld to show support, that Nintendo can't have it all. Pity PocketPair aren't a Triple-A dev team.

the proof is your purchase; if you sign up for a service and the terms of use are "by using this service you agree", and you use the service, you have legally agreed. even if you SAY you disagree, you are still using the service. you legally are bound by the ToS. please learn the law.

it's true that people don't read TOS/EULA, but that's not the fault of the company. it's true that many companies write obscenely long ones to deter the impatient consumer from reading them, but ignorance of law is not an excuse; if you break contract, you are at fault, even if you didn't know it. this is how the law works.

I know that it's popular on the Internet to complain about corpos (even rightfully most of the time) but let's remember that when you use a product you basically have signed a contract.

So the best is to not use them legitimately lol.
