My man, you're asking me to sue Instructor Trepe, the queen of ff8. I'll have to consider my position here carefully
Bro is careful with it

Okay, so upon further consideration of the facts regarding my client's request I've come to the conclusion that...
Instructor Trepe, you have accused my client of something without sufficient evidence to support your claims, and as we all know, this is not something the law can just turn a blind eye to.
However! Since it's well, YOU, I'll consider NOT sueing you if you reconsider your claims against my client, and uh... Ha! That's an interesting triple triad collection you got there isn't it?

I'll now be taking a rather long recess, so I suggest you think long and hard about this ::agree

The "Actual Malice Standard" does not apply in this case:

. The Sullivan court stated that "actual malice" means that the defendant said the defamatory statement "with knowledge that it was false or with reckless disregard of whether it was false or not." The Sullivan court also held that when the standard is actual malice, the plaintiff must prove actual malice by " clear and convincing " evidence, rather than the usual burden of proof in a civil case, which is the preponderance of the evidence standard. On this point, the precise language the Sullivan court uses is that the plaintiff must show "the convincing clarity which the constitutional standard demands."

I made no claims, as I have previously stated,

Ohhh, so you’re a legal expert now? You’re out here making borderline slanderous statements like you’ve passed the bar exam. Hope you’ve got a lawyer on speed dial, buddy.
You do realize that what you just said falls under the legal definition of implied defamatory insinuation, right? Courts have ruled on cases exactly like this, where vague statements like yours have been considered defamatory because they imply a false and damaging fact. Just saying ‘I think’ doesn’t always protect you—it’s about how a ‘reasonable person’ would interpret it. I mean, I don't want to sue you, but someone else might. Care to reconsider, Instructor?

I was never looking for a sue to begin. It was you and Ciro64 that brought up it up in the first place. I never said anything about passing bar either, didn't even imply that. Yes, sometimes cases do just judged guilty based on what you said. I used local evidence, where cases like this been found a non-guilty verdict. I still stand by what I said, be because there was no "implication" on my part that the post was just for 500. I didn't SERIOULY think it was.

Remember, YOU brought up charges. If you continue, you'll have to show proof beyond standard "burden of proof" that I actually thought Ciro64 only did make it for 500 post count. That's going to be very hard, on your side, since this is a public forum and I'm allotted limited First Amendment freedoms therein. So, since my first argument was not good enough (and I'm not sure why you think it's me suing when YOU brought up charges):

My post is protected under First Amendment speech. It didn't violate forum rules in any matter. And on top of that Circo64's reputation was damaged in no way. To the contrary- they were rewarded with 500 post reward. My above defense still applies too. It wasn't defamation, my intention was not in a disparaging manner, which you would have to prove with "Implication Defamation".

Ayo, serious talk, this is just a joke on my part, I'm doing this in a light hearted way and I find it fun so I would like to continue this back and forth with you, IF you're not bothered by this IRL, so we cool? I'm just saying this because I can't figure out if you're taking this seriously or not lmao

it's funny, and I know you meant it as much, but it is a little stressful, yeah.

I've actually been arrested before, for simply entering a stranger's house uninvited while I was going through a "Schizophrenic Episode" as they are called. I wasn't violent in anyway. I just went in their house and sat down on a couch. said nothing. It freaked them out bad though. It was considered Class A Misdemeanor. The charges got expunged from my record with no sentencing during my trial (which was just standing in front of a judge- non jury forum style.) Lots of ppl were there for sentencing.

American Justice System works against people like me fundamentally. That's a whole political thread on it own, and I'm not going there.

Had fun though! Good debate!

I didn't mean it to be stressful. It was just an honest answer. It happened years ago. Everything is OK with it now.
