NDS Why were atleast half of the pre-installed games in DS flashcarts shovelware games and/or homebrew instead of legitimately good games?

I recall owning atleast 3 flashcarts with pre-installed games (and I don't neccesarily mean those "3000-in-1" carts) and I noticed their lists were filled with more shovelware games and homebrew rather than games that were legitimately good. Why was that?
 
While my N64 came with all the official games on it, I'll tell a similar story:

Back in the day there were CD's packing a lot of games, often called Shovelware CDs. An example of those CDs would be "300 games in one!" but turns out these were all small games of questionable quality. Many of them were made in The Games Factory.

Then there were this CD called something along the lines "Play N64, SNES and Game Boy games on your computer!". It was an obvious buy, but upon examining its contents I was profoundly disappointed that all the roms were small techdemos that woudn't handle a candle to the real games.

The common theme here? Avoiding pissing off big companies! The little guy is not gonna come after us!

That being said... I grew a lot of affection for some of those "shovelware" games. Not only because some of them are actually good, but also because I feel like a archeologist when I see them. Most are rough around the edges sure, but they also are fascinating. Nowadays you associate small indie games with some pixelated game on itch.io, but back then there's no telling what kinda game you would find.

The most intriguing aspect of all: some of these games are very obscure, some to the point of not existing on the internet anymore. I regret not taking better care of my CDs and then uploading their contents to the internet archive, because there were some relics there.

Heh I really got Carrie'd away. But that's what forums are for.
 
Same thing happened with the ATGames Genesis releases. Half the games were actual titles from the system’s core library, whereas the other half were crappy bootleg titles. Not all were horrible, but it was filled with them. Again, it’s a copyright thing.

Actually, where would anybody have been able to purchase R3 cards back in the day? I never owned one, but my bf did and it came with Pokémon Heart Gold preloaded.

A lot of mom and pops had that in my area, though the first ones I saw were R4s. My boss at the time even gave me one for christmas, heh.

As for the weird games, I'm guessing it's solely to boost the amount of games they can say it has. There are ones that say 400-in-1 and it's really just 100 that repeat, stuff like that.
 
I never bought a flashcart that came with an SD card and pre-installed games. I had a legit R4 back in the day, a DSTT, an Acekard 2i, and now I just use cheap R4 Gold clones.
